General Terms and Conditions (GTC) 

 

Preamble  

In these General Terms and Conditions ("GTC"), the masculine form is used for personal designations and personal nouns. Corresponding terms apply to all genders and gender identifications of any kind for the purpose of equal treatment. The abbreviated form of the language is used for editorial reasons only and does not imply any evaluation. 

 

General information  

Alpinewings Paragliding only offers tandem flights. My offers are only available to a person (customer) who has read, understood and accepted every point of these terms and conditions. With the acceptance of the booking by Alpinewings Paragliding, a contract is concluded between the customer and Alpinewings Paragliding. These terms and conditions form an integral part of this contract. By making a booking, the customer assures that he is in good physical and mental health. The customer confirms that there are no health reasons which would exclude suitability for participation. He is responsible for good footwear and appropriate clothing. The contract obliges the customer to strictly follow the instructions of the tandem pilot. No one will be forced or obliged to take off. If a customer feels unsafe or uncomfortable, they should inform the pilot who will take appropriate action. A flight day may be postponed or cancelled for safety reasons.

 

Disclaimer 

The customer acknowledges that paragliding involves inherent risks. Participation in tandem flights is at your own risk. Any liability on the part of Alpinewings Paragliding, its tandem pilot (owner Noel Roje) or other auxiliary persons for damages to participants is expressly excluded. Alpinewings Paragliding accepts no liability for damage and/or theft of personal items (valuables) during the flight. Alpinewings Paragliding is not liable for damages caused by the actions of third parties, other participants, natural disasters, etc., or for delays in the flight programme. 

 

Tandem Flights 

 

General information: 

The customer expressly declares that he is in good physical and mental health, does not weigh more than 110 kg, and does not suffer from cardiovascular disease, vestibular disorders, neurological disorders or any other disease, including chronic diseases. The customer also declares that he is able to withstand the stress of the flight. In each of these cases, the activity takes place at the customer's own risk. It is the client's responsibility to cancel the flight if: 

  • No theoretical briefing has taken place. 
  • He has not understood all or part of the briefing. 
  • He is under the influence of alcohol, drugs or medication which impairs his judgement and ability to act. 

 

The customer accepts the conditions of Alpinewings Paragliding by sending the booking, paying the invoice amount, giving a verbal order for an activity and/or signing / redeeming gift vouchers. It is the customer's responsibility to wear suitable clothing (weatherproof, windproof, dirt-repellent), preferably sturdy shoes (over the ankles) and tearproof gloves. The tandem pilot is responsible for providing head protection (helmet) and flying equipment. Passengers under the age of 18 require the signature of both parents/guardians.  

 

It is the customer's responsibility to immediately and unconditionally follow the pilot's instructions. This is for your own safety. In particular, failure to follow instructions during take-off, flight and landing may result in serious injury to the customer and the pilot. If the pilot's instructions are not followed, the pilot may cancel the flight. In the event of non-compliance, the customer will not be entitled to a refund. The customer is liable for any personal injury resulting from failure to comply with the pilot's instructions. The customer is liable for any damage to equipment, pilots or third parties caused intentionally or by gross negligence. 

 

Prices and Services:  

The prices and services are according to the current listings on the website alpinewingsparagliding.ch. Prices are per person in Swiss francs. Prices are subject to change. 

 

Payment:  

The flight fee must be paid immediately after booking as a general rule. However, for last-minute bookings, there is the option to pay the fee right before the flight using a credit card, with a mobile device being used for the transaction. Cash payments are only considered in exceptional cases. Every booking is confirmed by Alpinewings Paragliding in one of the following ways: in writing, by phone, or via email. It is important to note that the fee must always be paid immediately after booking and before the flight, with credit card being the preferred method of payment. The passenger is responsible for covering the costs of using the mountain railway.

 

Agreed dates/weather:  

Paragliding flights are dependent on the weather. For this reason, Alpinewings Paragliding will contact the passenger between 18:00 and 20:00 the evening before the flight. If the weather is not suitable for flying, the flight will be postponed. 

 

Cancellation or Contract Modification by the Customer:  

Flight bookings and reservations are binding. Cancellations are free of charge up to 48 hours before the scheduled date. If a booking is cancelled less than 48 hours before the date, only 50% of the paid amount will be refunded. Customers who are close to departure (2 days or less) and cannot realize their flight due to weather conditions will receive a full refund of the booking amount. In such cases, the affected customers are required to provide proof of their journey (flight ticket) upon request of the owner. No refund will be issued for no-shows or for violations of the participation conditions. 

 

Liability & Insurance:  

Paragliding is not considered a high-risk sport in Switzerland, but the risk of an accident cannot be completely excluded. It is the customer's responsibility to take out accident insurance. It is the customer's responsibility to ensure that he has adequate health and accident insurance cover, including for paragliding activities. The standard accident insurance, which is compulsory for employees in Switzerland, generally provides good coverage. 

Customers do so at their own risk. Alpinewings Paragliding, represented by the owner and sole tandem pilot, is only liable for damage caused by gross negligence or intent on the part of Alpinewings Paragliding. To the extent permitted by law, passengers waive all claims against Alpinewings Paragliding that go beyond the existing insurance benefits. 

The liability insurance of Alpinewings-Tandem covers damages up to CHF 5 million. 

 

Data Protection:  

Alpinewings Paragliding undertakes to electronically process and store the personal data of customers within the framework of the contractual relationship without unauthorised disclosure to third parties. The customer should be aware that, according to the current state of technology, complete data security cannot be guaranteed during transmission via the Internet. At the customer's written request, their personal data will be destroyed after the end of the service.

Applicable law and jurisdiction:  

The contractual relationship is exclusively subject to Swiss law. The registered office of Alpinewings Paragliding is agreed as the exclusive place of jurisdiction. Alpinewings Paragliding reserves the right to assert claims at the customer's place of residence. Should individual provisions of these General Terms and Conditions be invalid or incomplete, the invalid or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid or incomplete provision. This shall not affect the validity of the remaining provisions.  

 

Participants from the USA or Canada acknowledge that there is no agreement on jurisdiction for the USA or Canada and that Alpinewings Paragliding does not accept legal proceedings in these countries.
